Think again. Some of the biggest brands in the world have been sued and paid dearly. If it can happen to them, it can happen to you.

ADA Lawsuit Statistics You Need to See

2,014 Lawsuits Filed in Just the First Half of 2025
That's a 37% increase over the same period in 2024. Website accessibility lawsuits are accelerating -- not slowing down.
California Is One of the Top 3 States for Filings
380 cases were filed in California in just the first six months of 2025, led by Los Angeles County. California businesses also face additional exposure under the Unruh Civil Rights Act on top of the ADA.
Small Businesses Are the Primary Target
Nearly 67% of all ADA website lawsuits target companies with less than $25 million in annual revenue. If you think you're too small to be sued, you're exactly who they're looking for.
Settlements Range from $5,000 to $75,000 -- Plus More
That's before attorney fees, redesign costs, and ongoing monitoring expenses. A single lawsuit costs far more than fixing your site now.
Overlays Like UserWay Make Things Worse
25% of all lawsuits in 2024 specifically cited accessibility widgets as barriers -- not solutions. The FTC fined one major overlay provider $1 million for false advertising. Overlays are not compliance.
No Warning Required
Plaintiffs can file against your business with zero notice. By the time you hear about it, you're already being sued. The only protection is a compliant website.

Any website can be sued for ADA non-compliance, including yours.

The Department of Justice has made clear that websites are covered under the Americans with Disabilities Act. That means if your site isn't accessible, you're exposed, regardless of your industry, size, or intent.
Demand letters are hitting small businesses daily. The average settlement runs $23,000 or more, plus attorney fees up to $15,000. And unlike other lawsuits, these cases don't require proof of intent.
The question isn't whether ADA lawsuits are real. It's whether your site is protected.

ADA Sites Website Compliance

Most websites fail basic WCAG 2.1 accessibility standards and their owners have no idea.

WCAG 2.1 defines 78 pass-or-fail checkpoints covering contrast, keyboard navigation, screen reader compatibility, and more. Failing even a handful puts you at risk.

Overlays and plugins like UserWay won't protect you. Courts have repeatedly ruled they are not sufficient for compliance. Real protection requires a real audit and a real fix.

That's exactly what we do.

Making your website accessible isn't just about avoiding lawsuits -- it's good for your business. Here are five reasons why ADA compliance is worth the investment.

Reach a Larger Audience
About 1 in 4 Americans lives with some form of disability. An inaccessible website turns away a significant portion of potential customers. When your site works for everyone, you open the door to more traffic, more engagement, and more business.
Better SEO Rankings
Many of the same practices that make a website accessible also make it perform better in search engines. Clean code, descriptive alt text, logical heading structure, and fast load times all contribute to higher Google rankings -- and more visitors finding you organically.
Stronger Brand Reputation
An accessible website tells your customers that you care about everyone -- not just the majority. Inclusivity builds trust, and trust builds loyalty. Businesses that demonstrate a commitment to accessibility stand out from their competitors.
Protect Yourself from Lawsuits
ADA compliance is a legal requirement for businesses open to the public -- and that includes your website. A single lawsuit can cost $23,000 or more in damages, plus attorney fees. Remediation is a one-time investment that protects you going forward.
Better Experience for Everyone
Accessibility improvements benefit all of your visitors -- not just those with disabilities. Clear navigation, readable text, well-labeled forms, and fast-loading pages make for a better experience across the board, which means lower bounce rates and more conversions.

What does ADA compliance actually involve?
ADA compliance means your website can be used by people with disabilities -- including those who are blind, deaf, or who navigate using a keyboard instead of a mouse. Compliant websites have descriptive text on all images, captions on videos, proper color contrast, keyboard-friendly navigation, correctly labeled forms, and code that works with screen readers. It follows a standard called WCAG 2.1 AA, which is what the courts use as the benchmark.
Why wasn't my site built this way originally?
Honestly, web accessibility was rarely enforced for small business websites until recently. Lawsuits started hitting hard around 2020-2022 and have exploded since then. Most web developers -- including large agencies -- simply weren't building to these standards because there was no real consequence. It's not about how your site was built. It's about where the law is today. The good news is it's fixable.
Can't I just add an overlay or widget like UserWay?
Overlays like UserWay are a popular quick fix, but they don't fully protect you. Courts have ruled that overlays do not constitute compliance, and lawsuits have been filed against sites that were actively running them. They can help as a temporary measure, but they are not a substitute for true remediation of your site's underlying code.
What happens if my site isn't compliant?
You can be sued under the Americans with Disabilities Act (ADA). There is no warning required -- plaintiffs can file immediately. Minimum damages start at $23,000, and attorney fees can add another $15,000 or more on top of that. These cases are often brought by serial plaintiffs who target small business websites specifically because they are easy wins.
How long does it take to make a site compliant?
It depends on the size and complexity of your site. A small business website typically takes one to three weeks. Larger sites with lots of content, videos, forms, or PDFs can take longer. We will give you a timeline estimate after reviewing your site.
How much does it cost?
Pricing varies based on the size of your site and the number of issues found. Contact us for a free scan and quote. What we can tell you is that our remediation cost is a fraction of what you would pay in a single lawsuit -- and peace of mind is worth a lot.
Will my site stay compliant after you fix it?
It will be compliant at the time of remediation. However, every time you add new content -- images, pages, videos, forms -- those additions need to meet the same standards. We offer ongoing monitoring packages to help you stay protected as your site grows and changes.
